前スレの　>993 でお願いした者です。
ライセンスの件でも良いとおっしゃったので。
単に英文の機械的な翻訳ではなくて、法的な観点からの解釈を
お願いしたいと思います。

英文を翻訳する際、ウェブ上の機械翻訳を利用したいとします。
Google翻訳の場合、グーグル利用許諾（エンドユーザー・ライセンス）を
守らなくてはいけません。
Googleの機械翻訳を利用しようとしたとき、以下２つの記載箇所が重要だと思いまして。

Google gives you a personal, worldwide, royalty-free, non-assignable
and non-exclusive license to use the software provided to you by Google
as part of the Services.

This license is for the sole purpose of enabling you to use and enjoy
the benefit of the Services as provided by Google,

前記は英語の原文で、もちろん日本語対訳も掲載されています。
利用者がこの機械翻訳を利用したら、出来上がった成果物（翻案・翻訳）の著作権が誰に
帰属するのか？です。グーグル社が二次的著作物だと主張しているのかという点です。
このライセンス全文から判断して、そう捉えるのが妥当なのかです。

私はライセンスを読みましたが、そのようには解釈できません。
翻訳物の著作権は、依然として元のユーザーに帰属すると読めませんか？
機械翻訳は、一般的には二次的著作物と見なさないと考えられます。
仮に、オープンソース・ソースソフトウェアに係るドキュメントを翻訳しても、
何ら問題が発生しないように思うのですが、いかがでしょうか。

たとえば、ググって機械翻訳にかけたら、私の解釈に近いように思えます。
修正したら修正した人のもの、というのは、創造性があればということでしょうか？

ソフトウェア・プログラムの翻訳作業で思い浮かべることといえば、
操作マニュアルや仕様、ライセンスのテキスト、インターフェースの表示の
置き換えなどだと思います。
おおよそ技術的な内容なので、翻訳したところで創造性は低いと考えます。
